Australian tennis star Nick Kyrgios will apply to have an allegation he assaulted his former girlfriend Chiara Passari dismissed on mental health grounds.

Kyrgios, 27, was in Tokyo playing in the Japan Open as the criminal matter against him was heard for the first time in the ACT Magistrates’ Court on Tuesday morning.

His lawyer, Michael Kukulies-Smith, said that after reviewing Kyrgios’s medical history, including his mental health, he would make an application under a section of the Crimes Act to have the matter dismissed due to mental impairment.

“It’s my client’s preference to attend in person,” he said of the upcoming application, expected to be heard later this year.

Kyrgios was due to play Chilean Cristian Garin in a semi-final at Wimbledon when the allegation was first made public in July.

More to come.
